Sadad Terms and Conditions
This user agreement is a contract between you and Sadad PAYMENT SOLUTIONS (“Sadad”), a company under the laws of QATAR, governing your use of your Sadad account and the Sadad services. If you are an individual, you must be a resident of QATAR and at least 18 years old to open a Sadad account and use the Sadad Services. If you are a business, the business must be organized in, operating in, or a resident of, QATAR to open a Sadad account and use the Sadad Services. By opening and using a Sadad account, you agree to comply with all terms and conditions in this user agreement, including that you are the beneficial owner of the Sadad account, and conduct business only on behalf of yourself.
You agree to comply with the following additional policies on this page.
Please read carefully all of the terms and conditions of this user agreement, the terms of these policies and each of the other agreements that apply to you.
We may amend this user agreement and any of the policies listed above from time to time. The revised version will be effective at the time we post it, unless otherwise noted. If our changes reduce your rights or increase your responsibilities, we will post a notice on the Policy page of our website and provide notice to you of at least 14 days. If you do not agree to the revised terms and conditions, you must stop using the Sadad services, close your account, and terminate your relationship with us without cost or penalty. This user agreement will continue to apply to your previous use of our services.
Sadad is a payment services provider in QATAR. Our services allow you to send payments to anyone with a Sadad account.
Not all Sadad services may be available to you and Sadad may at its discretion withdraw any service to you without notice. Sadad offers the following services in QATAR:
- Sadad Payment Services which allows you to receive payments from buyers for the sales of goods and services inside QATAR.
Sadad acts as an intermediary for receipt of funds from buyers by sellers and does not act as a repository or custodian with respect to such funds. For Sadad Payment Services, Sadad is only responsible for depositing the sales proceeds with the authorized dealer bank.
In this user agreement, “Sadad Service” means the payment gateway processing services offered by Sadad to its users who are resident in QATAR to facilitate receipt of payments from a buyer for credit into their bank accounts.
Definitions
For the purpose of this Agreement:
- “Acquiring Banks” shall mean various banks, financial institutions, Card Associations, payment system providers.
- “Acquiring Bank Services” shall mean the payment gateway system and services provided by the Acquiring Banks such as to (i) route internet based Valid Card transactions. (ii) offer various facilities through the internet, including Net Banking facilities. (iii) provide Authentication and Authorization from Card Associations or other third party clearing houses. and (iv) provide settlement facilities in respect of payment instructions initiated by the customers.
- “Authentication” shall mean the process by which the Customer’s identification is authenticated by the Acquiring Banks.
- “Authorization” shall mean the process by which the Issuing Institution and/or the relevant Card Association electronically or otherwise convey the approval of the charge (i.e. if the Customer has a Valid Card and/or the required credit limit/ debit limit to pay the Customer Charge requested) on a Transaction being undertaken by a Customer on your Website.
- “Business Days” shall mean any day on which Acquiring Banks are open for business in QATAR, other than Saturday, Sunday and any days declared by us and/or Acquiring Bank as a Holidays.
- “Card Association(s)” shall mean any of Visa, MasterCard, Visa Electron, Maestro, Diners, American Express or any other card association as may be specified by us from time to time.
- “Card Association Rules” shall mean the written rules, regulations, releases, guidelines, processes, interpretations and other requirements (whether contractual or otherwise) imposed or adopted by any Card Association.
- “Chargeback” shall mean reversal of the value of the Customer Charge with respect to any Transaction, inter alia, on account of (i) alleged forgery of the card number / bank account or other details (ii) any charge/debit made on a card that has been listed as a hot listed card or otherwise listed on the Card association warning bulletins (iii) duplicate processing of the transaction; or (iv) for other reasons as per applicable rules and guidelines issued by financial institution in Qatar, Card Associations, Acquiring Banks and Issuing Institutions. In addition, it shall include any debit to the Sadad’s bank account to recover the value of the Customer Charge in the event that you have insufficient funds in the Nodal Account and/or you fail to pay for the same.
- “Completion of Transaction” shall mean Sadad Completion of Transaction or if Sadad demands Proof of Delivery.
- “Confidential Information” shall mean any and all written, oral or other tangible or intangible form of information, discoveries, ideas, concepts, know-how (whether patentable or copyrightable or not), research, development, designs, drawings, blueprints, diagrams, models, samples, flow charts, data, computer programs, disks, diskettes, tapes, algorithms, software programs, marketing plans or techniques, technical, financial, or business information” trade secrets which includes but is not restricted to any portion or scientific or technical or proprietary information, design, process, procedure, formula or improvement which is not generally available to the public as delivered by either Party (“Disclosing Party” to the other Party (“Receiving Party”) within the framework of this Agreement or resulting therefrom. Provided that confidential information disclosed orally or those produced by electronic media or through any other intangible means shall be deemed confidential if it is identified as being confidential if it is reduced in writing within (30) thirty days of the date of disclosure. Such writing shall specify the date, time, place, persons involved and the substance of the confidential information so disclosed.
- “Customer” shall mean an individual or legal entity, who/which purchases Products, offered by you on your Website or Mobile Application or through IVR System and is directed to the Internet Payment Gateway using a Valid Card or Net Banking account or any other acceptable modes of Payment Mechanism, provided by us.
- “Customer Bank Account” shall mean a bank account or credit/ prepaid/ cash card account of the Customer with Issuing Institution.
- “Customer Wallet” shall mean a digital prepaid instrument held by the Customer with the Issuing Institution.
- “Customer Charge” shall mean the sale price of the Products purchased by the Customer plus the shipping charge (if any) and all other taxes, duties, costs, charges and expenses in respect of the Products/payment that are to be paid by the Customer.
- “Delivery” shall mean (i) in respect of a good, delivery of the good by a courier/parcel service appointed by the you or your vendors, to the Customer within Delivery Due Date at the address specified by the Customer in this behalf; or (ii) in respect of a service, delivery or performance of provisions of service within the Delivery Due Date.
- “Delivery Due Date” shall mean the date/period displayed on the Website or otherwise notified to the Customer on or before which you shall deliver the Products to the Customer(s).
- “EMI” shall mean equated monthly installment payment plan schemes of various Issuing Institutions which Sadad offers you.
- “Issuing Institution” shall mean a bank or financial institution or other legal entity, with which the Customer has a Customer Wallet and/or which has issued the Valid Card to the Customers (explanation: except for debit card or credit card Transactions, the Issuing Institution of the Customer and the respective Acquiring Bank will be the same).
- “Merchant Bank Account” shall mean the bank account maintained and nominated by you for settlement of your Settlement Amount.
- “Merchant Site” shall mean your website or Mobile Application as detailed in the Merchant Service Form or the IVR System hosted by Sadad for you.
- “Mobile Application” shall mean a software application that runs on smart phones, tablet computers and other mobile devices, the contents of which are controlled, operated and owned and established by you, for the purposes of enabling the Customers to view Products and carry out Transactions for purchase of Products, offered on the Mobile Application.
- “Mobile SDK” shall mean proprietary mobile software development kit, a custom mobile software application and packaged Application Programming Interface codes (APIs) developed by Sadad.
- “Net Banking Account” shall mean the facility and internet account provided by the Issuing Institution to Customers holding a bank account or digital wallet account with the Issuing Institutions specified by Sadad from time to time. Provided that the bank account is not listed in current warning or restricted bank account bulletins or notices.
- “Nodal Account” shall mean an inoperative account held by Sadad with any of the banks for the purpose of pooling the monies collected from Customers on your behalf and facilitating the transfer of these funds in final settlement to you.
- “Nodal Bank” shall mean the bank(s) designated by Sadad for the purpose of pooling the funds collected from Customers on your behalf and facilitating the transfer of these funds in final settlement to you (after deducting TDR).
- “One Click Checkout” shall mean the facility provided to the Customers to save its Valid Card details on the Sadad server to purchase the Products from the Merchant Site with a single click.
- “Outstanding Amount” shall mean the amount payable by you to Sadad, Acquiring Banks and/or Customers for any losses, costs, damages, penalties, Chargebacks, refund overdraft or credit problems suffered or incurred by the Customers, Sadad and/or Acquiring Banks; any fees and other payments owed to Sadad by you; and any claims or proceedings filed against Sadad and/or Acquiring Banks by the Customers or any third Party.
- “Payment Mechanism” shall mean the mechanism of making payment by utilizing the internet facilities of various Acquiring Banks, Card Associations, card payment systems and through such other modes and mechanisms of payment and delivery as may be notified by Sadad from time to time.
- “Sadad Account” shall mean the merchant account maintained with Sadad in order to provide the Sadad Services to you.
- “Sadad Site” shall mean the websites provided by Sadad Payment Solutions Private Limited (i.e https://sadad.qa) by means of which Sadad provides aggregative Internet Payment Gateway services to you and the Customers.
- “Products” shall mean goods and/or services offered for sale by you on the Merchant Site.
- “Proof of Delivery” shall mean sufficient legitimate records evidencing Delivery of the Product to the Customer (i.e. Courier Company’s delivery confirmation and delivery confirmation by the Customer).
- “Reserve” shall mean the interest free, refundable funds provided and replenished by you to Sadad from time to time.
- “Settlement Amount” shall mean Customer Charge minus the TDR and any other charges/fees payable by you to Sadad under this Agreement.
- “Transaction” shall mean every payment request/order placed by the Customer on the Merchant Site for purchasing Products from you.
- “Upgraded Mobile Application” shall mean the Merchant’s Mobile Application integrated with the Mobile SDK
- “Valid Card” shall mean any unexpired credit card or debit card which is issued by an Issuing Institution designated to issue a Visa, MasterCard, Visa Electron or a Maestro or cash card, pre-paid card or other card as may be specified by Sadad from time to time. Provided that the card is not listed in current warning or restricted card bulletins or notices and bears the signature of the person in whose name the card is issued.

Sadad PAYMENT SOLUTIONS requires pre-approval to accept payments for certain services mentioned below:
- Airlines and scheduled or non-scheduled charters/jets/air taxi operators; collecting donations as a charity or non-profit organization; dealing in jewels, precious metals and stones; acting as a money transmitter or selling stored value cards; selling stocks, bonds, securities, options, futures (forex) or an investment interest in any entity or property; or providing escrow services.
- Providing file sharing services or access to newsgroups; or selling alcoholic beverages, non-cigarette tobacco products, e-cigarettes or prescription drugs/devices. For approval please send contact information, business website URL and a brief business summary to www.sadad.qa
If you received an error that your payment was declined, we recommend reaching out to your card company or card-issuing bank. The fastest way to reach them is by calling the number on the back of your card.
Sadad Payment Solutions is unable to see the exact reason why the payment was declined. Calling the number on the back of the card should help.
If you received an email that a recent payment you made from a bank account has failed, you’ll want to login from a computer and head to www.sadad.qa to resolve the issue. Your account will also be temporarily frozen until the funds are paid back.
Bank payments can fail for a number of reasons. While Sadad Payment Solutions doesn’t have visibility into the specific reason your payment failed, your bank should be able to tell you exactly why.
The fastest way to get your account reinstated is to use a card to pay back the amount. Paying with your bank is also an option, but keep in mind these payments can take a few days to process. In any case, once Sadad Payment Solutions receives the funds, your account will be reinstated.
- Involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent
- Attempt to sell any products falling in the category of product prohibited for sale in qatar under any law for the time being in force.
- Violate any law, statute, ordinance or regulation at qatar.
- Ensure that the content of the products, the text descriptions, graphics or pictures (“content”) in respect of the catalogue regarding the product being uploaded on the e commerce platform and the product packaging, shall not be obscene, libelous, defamatory or scandalous or which is capable of hurting the religious sentiments of any segment of the population or constitute an infringement of any intellectual property rights of any person or entity.
- You shall not use the sadad payment solutions service for activities that relate to transactions involving:
- Narcotics, steroids, certain controlled substances or other products that present a risk to consumer safety,
- Drug paraphernalia,
- Cigarettes,
- Items that encourage, promote, facilitate or instruct others to engage in illegal activity,
- Stolen goods including digital and virtual goods,
- The promotion of hate, violence, racial or other forms of intolerance that is discriminatory or the financial exploitation of a crime,
- Items that are considered obscene,
- Items that infringe or violate any copyright, trademark, right of publicity or privacy or any other proprietary right under the laws of any jurisdiction
- Certain sexually oriented materials or services,
- Ammunition, firearms, or certain firearm parts or accessories, or
- Certain weapons or knives regulated under applicable law
- You shall not use the sadad payment solutions service for activities that; relate to transactions that:
- Show the personal information of third parties in violation of applicable law,
- Support pyramid or Ponzi-schemes, matrix programs, other “get rich quick” schemes or certain multi-level marketing programs,
- Are associated with purchases of annuities or lottery contracts, lay-away systems, off-shore banking or transactions to finance or refinance debts funded by a credit card,
- Are for the sale of certain items before the seller has control or possession of the item,
- Are by payment processors to collect payments on behalf of merchants,
- Are associated with the sale of traveler’s checks or money orders,
- Involve currency exchanges or check cashing businesses,
- Involve certain credit repair, debt settlement services, credit transactions or insurance activities, or
- Involve offering or receiving payments for the purpose of bribery or corruption
- Involve the sales of products or services identified by government agencies to have a high likelihood of being fraudulent
- Activities involving gambling, gaming and/or any other activity with an entry fee and a prize, including, but not limited to casino games, sports betting, horse or greyhound racing, fantasy sports, lottery tickets, other ventures that facilitate gambling, games of skill (whether or not legally defined as gambling) and sweepstakes, if the operator and customers are located exclusively in jurisdictions where such activities are permitted by law.
